Introduction These Terms of Service (“Agreement”) set forth the terms and conditions of your use of the hosting and related services (“Services”) provided by The Bomb Enterprises Inc. (“we,” “us,” “our”). By using our Services, you (“you,” “your,” “user”) agree to comply with and be bound by this Agreement. If you do not agree to these terms, please do not use our Services.
1. Term of Agreement; Modification You agree that The Bomb Enterprises Inc. may modify this Agreement and the Services it offers from time to time. You agree to be bound by any changes we may reasonably make to this Agreement when such changes are made. If you continue to use the Services after any revision to this Agreement, you agree to abide by and be bound by those changes.
2. Accurate Information You agree to maintain accurate information by providing updates as needed while using the Services. You will notify us within five (5) business days of any changes to the information you provided during the registration process. Failure to respond to inquiries regarding the validity of your information within five (5) business days constitutes a material breach of this Agreement.
3. Privacy Our Privacy Policy, which is incorporated by reference, applies to all Services. We will not use your information in any way inconsistent with the purposes outlined in the Privacy Policy. You agree that we may modify the Privacy Policy, and by continuing to use the Services after such modifications become effective, you agree to these modifications.
4. Acceptable Use Policy You agree to use the Services for lawful purposes only. Prohibited activities include, but are not limited to:
- Abusive language, spamming, hacking attempts.
- Fraudulent activities, impersonation, unauthorized access.
- Distribution of malware or harmful software.
- Disruptive activities affecting the Site’s functionality or infringing on others’ rights.
5. User Accounts Users must create accounts to access their dashboard, which includes website information, billing details, customer support, and sales. Users must be at least 13 years old to create an account.
6. Intellectual Property Users cannot submit public content such as reviews or comments but can contact us and upload attachments. User-generated content is owned by the user. Our trademarks, logos, or content cannot be used without consent from our legal team at [email protected].
7. Payment Terms We accept EFT, ACH, PAD, and major credit cards via Stripe. We do not offer refunds on subscriptions or on work already provided. Services can be canceled with 30 days’ notice unless specified otherwise in a contract. Services will terminate at the end of the next billing period following cancellation. All products are electronically delivered; hence, there is no return policy.
8. Accuracy of Information We strive to ensure the information on our Site is accurate but cannot always guarantee it. We reserve the right to refuse service and terminate accounts for illegal activities or terms violations. We are not responsible for legal actions arising from users’ activities or content.
9. Limitation of Liability and Disclaimers The Bomb Enterprises Inc. disclaims liability for any loss or damage arising from the use of the Services or the Site. Users are solely responsible for their activities’ legality and compliance with applicable laws. We are not liable for any legal issues stemming from users’ website content or actions.
10. Account Termination and Suspension We may terminate or suspend accounts for overdue payments, suspected fraud or chargebacks, participation in illegal activities, or other violations of this Agreement. We will notify the account holder via phone or email 30 days in advance before permanently erasing all data.
11. Governing Law and Dispute Resolution These Terms are governed by the laws of Canada and/or the United States. Any disputes arising from these Terms or your use of the Site may be resolved in court.
12. Changes to Terms We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. You are advised to review these Terms periodically. Changes are effective when posted on this page.

15. Termination & Cancellation Policy The initial term of your agreement begins upon the commencement of the Services. This Agreement may be terminated by you via a helpdesk ticket at least three (3) working days before the account renewal date. We may terminate this Agreement at any time without prior notice if you violate any terms. In the event of termination, no pre-paid fees will be refunded.
16. Customer Support Customer support is provided for issues related to our services only. Support requests must be submitted through the HelpDesk system in the Customer area. Abuse of the HelpDesk system, such as excessive requests or aggressive behavior, may result in account suspension or termination without refund.
17. Legal Purposes Our services can only be used for legal purposes under all applicable laws. Violations of this Agreement may result in termination of services without notice.
18. Ownership All intellectual property rights related to the Services are owned by The Bomb Enterprises Inc. or its partners. You do not acquire any rights other than the rights expressly granted in this Agreement.
19. Indemnification You agree to defend, indemnify, and hold harmless The Bomb Enterprises Inc. from any claims, damages, or expenses arising from your use of the Services or violation of this Agreement.
20. Notices Any required notices will be deemed given if delivered to the contact information provided in your account.
21. Enforceability If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect.
22. Assignment and Resale Your rights under this Agreement are not assignable or transferable. Any attempt to assign or transfer your rights will render this Agreement voidable at our option.
23. Force Majeure We are not liable for any delay or failure to perform due to causes beyond our control, including natural disasters, war, terrorism, labor disputes, or governmental actions.
24. Headings The section headings are for convenience only and do not affect the interpretation of this Agreement.
25. Final Agreement This Agreement constitutes the complete and exclusive agreement between you and us. Any amendments must be in writing and signed by both parties.
26. No Agency Relationship This Agreement does not create any agency, partnership, or joint venture between the parties.
